Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites, applications, and services operated by Velkon, doing business at velkonco.com (collectively, the "Service").

By creating an account, signing a proposal, paying an invoice, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

You are responsible for keeping your account credentials secure and for all activity that occurs under your account. You must:

• Provide accurate and current information when creating your account.
• Use a strong, unique password and enable two-factor authentication when offered.
• Notify us at velkonsupport@gmail.com the moment you suspect unauthorized access.

We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a security or legal risk.

Velkon provides:

• Custom website design & build — quoted per project through our online configurator or a written proposal in your dashboard.
• Managed hosting — billed monthly at the rate shown on your billing page when you start your subscription.
• Ongoing support — through your dashboard tickets and the channels published on velkonco.com.

Specific deliverables, timelines, and pricing for each engagement are confirmed in your dashboard before work begins. Anything not explicitly listed is out of scope.

One-time build fees are calculated by our auto-quote based on the scope you submit. Hosting is billed on a monthly recurring basis from the date you start your subscription.

We currently accept manual payment via:

• Apple Cash (913-238-9056)

Invoices are due upon receipt unless otherwise stated. After paying, you must upload proof of payment in your dashboard so we can verify and activate your service — typically within 24 hours. Late, missed, or disputed payments may result in suspension or removal of hosted sites.

All amounts are in USD and exclude any applicable taxes, which are your responsibility.

We start work after the build invoice is paid and verified. Estimated delivery windows are shown in your dashboard and depend on the scope, your responsiveness, and the materials you provide (copy, logos, photos, integrations, etc.).

Each project includes a 5-day revision window after delivery. Reasonable design, copy, and layout tweaks within scope are included. Work outside the original scope, or requested after the revision window closes, is billed separately at our standard hourly rate.

Managed hosting includes edge CDN delivery, automatic SSL, monitoring, and backups appropriate to your tier. We target high availability but do not guarantee uninterrupted service. We may perform scheduled maintenance with reasonable notice.

You may cancel hosting at any time from the Billing page. Cancellation takes effect immediately: the site is taken offline and no further charges occur. Reactivation may require a setup fee.

You agree not to use Velkon to publish, host, or transmit content that:

• Is illegal, infringes third-party rights, or violates applicable regulations.
• Is defamatory, harassing, hateful, or sexually explicit involving minors.
• Contains malware, phishing, or attempts to compromise other systems.
• Is used for high-risk industries we don't support (e.g. unregulated financial schemes, adult content marketplaces, weapons sales).

We may suspend or terminate service immediately for violations, and we will cooperate with lawful requests from authorities. See our Acceptable Use Policy for the full list.

On full payment for the build, you receive a perpetual, non-exclusive license to use the delivered website (the "Deliverables") for your business. You may not resell or relicense the Deliverables to third parties.

Velkon retains all rights in our underlying design systems, code libraries, internal tooling, and any pre-existing materials we incorporate. We may showcase the project in our portfolio and case studies unless you ask us not to in writing.

Third-party assets (fonts, photography, plugins) are licensed per their respective providers; you are responsible for keeping those licenses current after handover.

Each party agrees to keep the other's non-public business information confidential and to use it only to perform under these Terms. This obligation survives termination.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free from harmful components.

To the maximum extent permitted by law, in no event shall Velkon be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising from your use of the Service.

Velkon's total aggregate liability for any claim arising out of or relating to these Terms or the Service is limited to the amounts you paid Velkon in the 12 months preceding the claim.

You may stop using the Service and cancel hosting at any time from your dashboard. We may suspend or terminate your account immediately if you breach these Terms, fail to pay, or use the Service in a way that creates legal or security risk.

On termination, your right to use the Service ends immediately. Sections that by their nature should survive (Payment, IP, Confidentiality, Warranty Disclaimer, Limitation of Liability, Governing Law) will survive.

We may update these Terms from time to time. The "Last updated" date at the top reflects the current version. Material changes will be announced in your dashboard or via email at least 7 days before they take effect. Continued use of the Service after changes constitutes acceptance.

These Terms are governed by the laws of the State of Kansas, USA, without regard to its conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Johnson County, Kansas, and you consent to the personal jurisdiction of those courts.
